The NDIS Quality and Safeguards Commission has begun operation in NSW and SA as of the 1st July 2018. This means that if an NDIS participant in either NSW or South Australia has a complaint or concern about a service provider supplying their NDIS funded supports, they will now need to contact the NDIS Commission rather than their local state Ombudsman.
The NDIS Quality and Safeguards Commission or NDIS Commission will begin operations in:
- NSW and SA from 1 July 2018
- ACT, NT, Queensland, Tasmania, and Victoria from 1 July 2019
- WA from 1 July 2020
The commission will operate as an independent statuary body with integrated functions and powers. It will receive and resolve or refer complaints about providers of NDIS funded supports. It will also monitor and investigate serious incidents, and build provider capacity to prevent and respond to serious incidents. It will investigate breaches of the NDIS code of conduct and will work with providers to develop a positive reporting culture.
It will take compliance action and will have a role in informing participants about their rights and complaints processes. Regardless of whether a service is a registered NDIS provider or not, if they are fulfilling the supports of NDIS participants, then they will be required to comply with the NDIS Code of Conduct.
